Harvard sues Trump administration over international student ban

Harvard University filed a lawsuit on Friday seeking to overturn President Donald Trump’s administration ban that prevents the private school from enrolling international students, citing allegations that the university tolerated “anti-American, pro-terrorist agitators” on campus.

The legal action followed the Department of Homeland Security’s recent decision to revoke Harvard’s authorization to enroll foreign students under the F-1 visa program, a move made at the request of Secretary Kristi Noem.

The DHS announced that Harvard is barred from enrolling new international students, and that current foreign students must leave the university or face losing their legal status in the U.S.

This ban impacts over 7,000 international students currently studying at Harvard.

The university has been targeted by Trump administration for months, with the president recently calling for Harvard to lose its tax-exempt status.

“With the stroke of a pen, the government has sought to erase a quarter of Harvard’s student body, international students who contribute significantly to the University and its mission,” the lawsuit filed in U.S. District Court in Massachusetts said.

“Harvard’s certification is essential for each of Harvard’s thousands of international students to lawfully remain in this country while they complete coursework, obtain degrees, and continue critical research,” the suit said.

In its lawsuit, Harvard described the revocation as a “blatant violation of the First Amendment” and the Due Process Clause of the U.S. Constitution.

The university argued that the move was the latest instance of government retaliation against Harvard for exercising its First Amendment rights by resisting efforts to control its governance, curriculum, and the “ideology” of its faculty and students.

On Thursday, the Department of Homeland Security said it revoked Harvard’s certification under the Student and Exchange Visitor Program, citing concerns that the university’s leadership “has created an unsafe campus environment by permitting anti-American, pro-terrorist agitators to harass and physically assault individuals, including many Jewish students, and otherwise obstruct its once-venerable learning environment.”
